Re-Framing the Gun Conversation

“We hold these truths to be self-evident, that all men are created equal, that they are endowed by their Creator with certain unalienable Rights, that among these are Life, Liberty and the pursuit of Happiness.” – American Declaration of Independence, July 4, 1776.

Today in America we continue to define, weigh, and measure these three “unalienable Rights”.

No matter whether the Declaration’s principal author, Thomas Jefferson, and the Committee of Five of the Second Continental Congress assumed these three Rights to be mutually compatible or whether they saw them in tension with each other, today in America there is little agreement about the meaning of, or the relations among, Life, Liberty, and the pursuit of Happiness. Instead we are locked in a heated debate about one of the three – Liberty – focused  on the Second Amendment to the U.S. Constitution, adopted in 1791.

Lost in the debate is the more reflective philosophical, moral, and religious pondering of the “unalienable Rights” which, in the eyes of Jefferson and the Second Continental Congress were essential virtues of a new republic. Then, as now, the way we understand life, liberty, and the pursuit of happiness is shaped, to some extent, by different cultural experiences. At the time of the Declaration of Independence, the differences were often between northern and southern colonies. Today the differences are still sectional, but perhaps even more, they are between rural and small town, urban, and suburban cultures and settings.

Rural and small town populations, especially those who plow the fields and grow our food, tend to view guns as instruments that support life and the pursuit of happiness. A gun is used for hunting, protecting the animals from coyotes, or for skeet shooting. The rifle by the back door is part of rural life, not meant to be used on another human being, except in the unlikely event of a burglary. The right to own and use a gun is a matter not only of liberty but of life and the ability to pursue happiness. The gun is a family friend.

Urban populations, especially those living in densely populated centers with the high crime rates that accompany economic deprivation, see guns differently. Guns in their neighborhoods are not for hunting, protecting animals, or shooting coyotes. They are threats to Life and the pursuit of Happiness. The cities are divided between very wealthy, middle class, and the economically impoverished neighborhoods where gun shots are heard while putting children to bed. Residents who can afford to leave for the suburbs to pursue Happiness sometimes do.

Suburban populations are a blend of former rural and urban dwellers with native suburbanites. Some grew up on the farm or in small towns where there was little or no tension among the three unalienable rights. Some left the city in pursuit of happiness or in search of a safe place to live. Some, born and raised in the suburb, can imagine neither the farm, small town, nor the city as a preferred place to live. In the suburbs it is a matter of some confusion and debate whether Liberty, as in gun rights, supports or conflicts with, Life and the pursuit of Happiness.

The National Sheriffs Association, serving rural and small town America, takes a conservative position on gun rights and gun control, while the National Association Chiefs of Police and International Association of Chiefs of Police, serving urban, small cities, and large suburban communities, call for improved gun control legislation.

Although informed debate about the origins and intent of the Second Amendment is good and necessary, a preoccupation with the Second Amendment all but insures the demise of a productive national conversation.

We would do better to look earlier in our history to the Declaration of Independence which defined the goals of a soon-to-be-born American republic. To this writer’s knowledge, there has been little if any discussion of gun rights and regulation in the context of the three unalienable rights explicitly lifted up in the document we all celebrate on July 4th.

Those who declared American independence from Great Britain in 1776 could not have imagined that one of the three named unalienable Rights — Liberty — would stand as the sole Right without reference to Life and the pursuit of Happiness.

Few venues lend themselves to a mature discussion among rural/small town, urban, and suburban American experiences. In theory, the 50 state legislatures and the United States Congress provide the forums for thoughtful discussion and the search for solutions by representatives of rural, urban, and suburban constituents. But in today’s America where representative government itself is often viewed with distrust and even fear, the likelihood of success is far less than the Founders might have hoped.

Where and how, then, do we, the people — rural and small town, urban, and suburban — citizens of the diverse country we all love, come together to discuss our life in light of the creative tension of the rights to Life, Liberty, and the pursuit of Happiness in 2015?

In 2015 one could hardly say we in America are happy. In the light of current tragedies of gun violence and our socio-poliictal history, we might do well to remember the wisdom of Aristotle (384—322 B.C.E) to help guide citizens of a constitutional republic:

Happiness depends upon ourselves.

Life, Liberty, and the Pursuit of Happiness

Here in the U.S. we’re fighting over who’s responsible for all the violence. “It’s people who kill, not guns,” say some opponents of gun control, defenders of a skewed rendering of the Second Amendment. But it’s also the guns, the bombs, the drones, the land mines, the missiles – the weapons manufacturers who kill and maim.  There’s nothing in the Second Amendment about the right to kill and maim.

More importantly and too often missing from the public discussion, the Preamble of the Declaration of Independence starts with certain “unalienable Rights, among which are the Right to “Life, Liberty, and the pursuit of Happiness.”

In that trinity of unalienable rights and values liberty means nothing unless it supports the right to life and the pursuit of happiness. Otherwise, it serves the purposes of death and sorrow. As Viv reminds us from France,

makers, sellers, buyers of weapons
are as guilty of murder
as those who use them.

Until we the people demand that liberty be returned to its rightful place, the weapons manufacturers will continue to make a killing on killing at home a abroad.

Mr. Cub and Dr. Borg

Ernie Banks, known with great affection against his protestations as “Mr. Cub”, died yesterday, two days after theologian Marcus Borg.

Each excelled in his respective field, Ernie in the ivy-covered walls of  “the Friendly Confines” of Wrigley Field, Marcus in the ivy-covered walls of the academy. Though their fields were different, their way of life was the same. It was humble.

Ernie objected to the “Mr. Cub” title, arguing that the designation should be shared among team members who excelled each year.

Marcus responded to the question “How do you know you’re right?” with “I don’t know. I don’t know that I’m right.”

Each was humble, and each anticipated death.

“I may have ten years left. Not sure I want more. There comes a time to let go. And I could, with gratitude, sooner than that. My life has been very blessed.”

Out from the caves of fear

Fear.

“There is no passion so contagious as that of fear,” wrote Michel de Montaigne.

During the five minute drive to Auburn Manor in downtown Chaska Monday morning, I turn on the radio to hear what they’re saying about the Vikings’ overtime victory over the Bears.

I turn to the ESPN sports channel. But it’s not about sports. It’s Glenn Beck advising listeners to buy food insurance. On the heels of the call to buy food insurance in preparation for catastrophe comes the advice on how to buy your first gun.

Passion. Contagion. Fear. They’re everywhere. Not just Glenn Beck and the far right, but on the left, in the middle, and among the apathetic and the cynical. Fear does not have one opinion. It is a contagious passion that has a thousand different voices. While the foundations of the familiar shake, we are infected by a pandemic of fear.

Fear does terrible things to a person and to a society. It is for this reason that the New Testament Gospels see fear as the root source of ill-will, self-absorption, greed, and war. The “Fear not” uttered by the heavenly messengers in Luke’s birth narrative is repeated in the middle and at the end of the Christ story. “Fear not, little flock.” “Fear not, for I am with you.” It is both invitation and command: “For you did not receive a spirit of slavery to fall back into fear…”.

We are always prone to fall back into fear. We fear because we are mortals. We die and we know it. We seek to secure ourselves against the threats, overt or covert, that cast death’s dark shadow over us.

In such times the psalmist comes to mind. “Yea, though I walk through the valley of the shadow of death, I will fear no evil.” I will buy no food insurance. I will buy no gun. To do so is to run straight into the arms of death as a living power that robs us of life’s goodness and meaning.

“Man’s self-absorption is the movement of our flight from death,” writes Sebastian Moore OSB. “This is what is meant by the scripture’s description of man as ‘under the shadow of death’. It does not mean ‘man knowing he will die’ but ‘what man does and becomes under this knowledge.’. It is not to our mortality, our animality, that scripture offers a remedy. It is to the death that we become in our self-absorption. It is to what we allow death to become in us by fleeing from it in the hopeless pride of man.” (The Crucified Jesus Is No Stranger, Paulist Press, 1977)

I turn off the radio. I dial back the passion. I interrupt the contagion of fear by repeating an old psalm, and drive over to the community food pantry to volunteer.

Just leave me alone!

FURTHER REFLECTION (gcs)

In the tradition of Nietzsche’s parable of The Mad Man who enters the public square at midnight to cry out “God is dead! God is dead! And we have killed him, you and I,” Willem Zuurdeeg (author of An Analytical Philosophy of Religion, and Man Before Chaos: Philosophy Is Born in a Cry), declared that

Christ has been crucified by an Order which refused to be disturbed by him (Dostoevsky’s legend of the Grand Inquisitor). Christ historically was killed by the justifying Order of the Law. We establish similar Orders!

Zuurdeeg was part of the compassionate underground in The Netherlands that provided refuge for Jews fleeing the horrors of the Order of the German Third Reich. He spent his life in search for an answer to the question of how such a proud and sophisticated culture could become the perpetrator of unthinkable evil. During his years in the United States, he saw once more a social, economic, political, religious Order (Western Democracy and Capitalism) that muzzles the shameless crying out for what we so desperately need (Freud).”Contrasted to modern man (sic) who cannot cry, primitive man (sic) was not ashamed to cry, and his culture provided him with living, vital forms of crying out.”

We are offered a significant choice, namely between two ways of being human. The difference between logical necessities or physical necessities and vital necessities is made clear in that in the latter we have the possibility of refusing ‘to turn away from a disaster’ – we can in fact choose a lesser way of being human over a fuller way. What is at stake in the necessity of cry is one’s own humanity, the meaning of one’s own existence, and to turn away from crying is to turn away from decision and responsibility. This is to deny the very possibility of becoming genuinely human.

Man Before Chaos , published after Zuurdeeg’s untimely death at the age of 57, ends with the unedited notes from the sermon he preached to his students and faculty colleagues in the McGaw Chapel of McCormick Theological Seminary. Here is the conclusion of his sermon.

God is dead (II). This is now turned around. In principle the man gods, of the Primitive Order, the Law, of the Founding Fathers, o9f Democracy, of Reason, of Being (Necessary Being, Being-Itself), of a moral World Order – these are the gods who are dead. They are “idols in the sense that they exist only because we believe in them. They are dead, in principle, in hope, though the present reality is different…. And the God who is alive is Jesus Christ.

Home of the scared and the land of the tyrannized

This afternoon from 3:00 to 4:00 Protect Minnesota will host a demonstration in the MN Capitol Rotunda in support of state legislation re: gun violence.

As part of its efforts, Protect Minnesota invited individuals to write letters to MN Senate and House Judiciary Committee members. This letter went out this morning.

Greetings,

I am a Christian Pastor. I write you out of deep concern for the unrestrained violence taking place in the name of “the right to liberty” that imperils “the right of life…and the pursuit of happiness”. The three rights proclaimed in The Declaration of Independence are intended to be mutually supportive, not mutually exclusive. The right to liberty was never intended to take the other two rights hostage.

I strongly support legislation and enforcement of laws that place gun ownership in its proper place in our common life. The Second Amendment does NOT grant unlimited rights for anyone to purchase and use a gun anywhere anytime any more than the First Amendment on free speech allows speech that slanders or libels, lies under oath, or yells “Fire!” in a crowded theater.

As Senators and Representatives, you were elected by the people in your districts. Once you took the oath of office, your responsibility changed. You entered the halls of representative democracy where leadership requires you to act by your own consciences, not by public opinion polls in your districts. We are a representative democracy, not a pure democracy). Your responsibility as Senators and Representatives is to LEAD WISELY not only for the sake of your own constituents but for the greater good of the entire State of Minnesota.

We are quickly becoming, if we are not already, an armed camp in which the “neighbor” of Jewish, Christian, and Islamic teachings is regarded as an anachronism. Unless you plug the holes in our background check system by requiring a check for every pistol or assault weapon sale, the rights of life and the pursuit of happiness will be held hostage by unrestrained liberty, and the home of the brave and the land of the free will continue on the way to become the home of the scared and the land of the unrestrained individual tyranny.

An Ash Wednesday Question

What do we do? How do we stop this?

“Motorists and walkers scattered in terror Monday night as a gunman fired two bursts of bullets at passing vehicles near an Oakdale grocery store, killing a 10-year-old boy and wounding two other people. Click HERE for the Start Tribune story.

We can‘t stop it. America is an arsenal with an open door. And any attempt to close the door is “unconstitutional”. Liberty, one of three basic rights outlined by The Declaration of Independence, is killing the other two. “Liberty” trumps not only “the pursuit of happiness” but “life” itself.

“At least two vehicles struck by bullets sped into the parking lot of the nearby Rainbow Foods at 7053 10th St. N. seeking help.”

Responsible gun owners did not do this. An irresponsible gun owner did this. But it would have made not one ounce of difference if the passersby had been armed. They were sitting ducks, like the ducks in a carnival booth. There is no protection against irresponsible use of a firearm.

Is the concern about violence in America – about life and the pursuit of happiness – equal to the concern for the constitutional right to bear arms? Can we talk about what is happening on the streets and in the schools across America without shouting that guns are not the problem – that people are the problem?

People are the problem. So are the lethal weapons like the one that made its way into the hand of the man who stands on a corner and fires at passers-by. These are not water pistols. These are not cap-guns. These are not bows and arrows. Can we talk about the problem of people using guns to kill their neighbors? Can we even have a discussion without the NRA holding us hostage?

Today is Ash Wednesday when Christians ponder the mystery of the Passion of our Lord Jesus Christ on the way to the cross.

“And while [Jesus] was still speaking, Judas came, one of the twelve, and with him a great crowd with swords and clubs, from the chief priests and the elders of the people. …And they came and laid hands on Jesus and seized him. And behold one of those who were with Jesus stretched out his hand and drew his sword, and struck the slave of the high priest and cut off his ear. Then Jesus said to him, ‘Put your sword back into its place; for all who take the sword will perish by the sword.’ “ (Gospel of Matthew 26:47-52)

In Luke’s version of the arrest, Jesus tells the disciple ‘No more of this!’ And he touched his ear and healed him.” (Gospel of Luke. 22:51)

“The 33-year-old gunman, who was in police custody Monday night, began firing a handgun about 6:10 p.m. while standing in the street near Hadley Avenue N. and 7th Street N….” – Star Tribune, Minneapolis, Minnesota, Feb. 12, 2013.

Life, liberty, and the pursuit of happiness are the three core rights of the Declaration of Independence. Faith, hope, and love are the great spiritual values of the Christian tradition. Our freedom is not found in a weapon. It is found in Jesus of Nazareth for who was executed after the angry crowd yelled for the release of the other criminal, Jesus Barabbas, the armed insurrectionist.

It’s Ash Wednesday. At his arrest, the Jesus who is arrested by an armed militia tells his uncomprehending disciple to put his sword away: “Those who live by the sword will die by the sword.”

“No more of this!” Please, for the sake of God, stop this!
